Terms of Service

These Terms of Service ("Terms") are an agreement between you and Peaks
Education ("Peaks", "we", "our") governing your use of our website,
applications, and services (collectively, the "Service").
By creating an account or using the Service you agree to these Terms.
If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to create an account. The Service is
intended for college and university students. We do not knowingly
collect information from anyone under 13 (see our Privacy Policy).
2. Your account
You are responsible for the accuracy of your account information,
maintaining the confidentiality of your credentials, and all activity
that occurs under your account. Notify us immediately at
support@peakseducation.com if you suspect unauthorized access.
You may have only one account. You may not transfer your account to
another person.
3. Acceptable use
You agree not to:
- Use the Service to cheat, plagiarize, or otherwise violate your
school's academic integrity policy.
- Submit content you do not have the right to submit, including
copyrighted exam materials, instructor-only content, or another
student's work.
- Reverse engineer, scrape at scale, or attempt to bypass rate limits
or access controls.
- Upload malware, conduct denial-of-service activity, or attempt to
access accounts you do not own.
- Use the Service to harass, threaten, or impersonate others.
We may suspend or terminate accounts that violate these rules.
4. AI-assisted features and academic integrity
The Service includes AI tutoring features that may produce explanations,
quizzes, examples, and other study aids. **AI output may be inaccurate,
incomplete, or misleading.** You are responsible for verifying anything
you rely on for academic work. The Service is intended as a study aid,
not a substitute for course instruction or for completing graded work.
You agree not to submit AI-generated content as your own academic work
where doing so violates your institution's policy.
5. Subscriptions and payments
Some features require a paid subscription. We offer:
- A monthly subscription billed in advance every 30 days.
- A semester subscription billed once for access through a specific
academic term.
Prices are listed at checkout and may change for new sign-ups, but
existing active subscriptions are not retroactively repriced.
Auto-renewal disclosure: monthly subscriptions auto-renew until canceled
in your billing portal. You will be charged on the renewal date using
the payment method on file. To cancel, visit the billing portal at
least one day before the renewal date.

7. Promotions and referrals
We may from time to time run promotions including referral programs and
charity-matching campaigns. Participation is voluntary and subject to
the rules posted at the time. Referral attribution is one-time and
non-transferable. We may invalidate referrals tied to refunded purchases
or to fraudulent activity.
8. Termination
You may close your account at any time. We may suspend or terminate
your account for material violations of these Terms, suspected fraud,
or where required by law. Upon termination we may retain logs and
backups for the periods described in the Privacy Policy.
9. Intellectual property
Peaks owns the Service, branding, and curated content. You retain
ownership of content you upload. By uploading content marked as
"communal" you grant us a non-exclusive license to display it to other
students within your school. You can withdraw shared content at any
time.
10. Disclaimer
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND,
EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS
FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee
that the Service will be uninterrupted, error-free, or that AI output
will be accurate.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEAKS' TOTAL LIABILITY ARISING
OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE
GREATER OF (A) THE FEES YOU PAID TO US IN THE 12 MONTHS BEFORE THE
EVENT GIVING RISE TO LIABILITY OR (B) ONE HUNDRED U.S. DOLLARS. IN NO
EVENT WILL PEAKS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR
CONSEQUENTIAL DAMAGES.
12. Governing law and dispute resolution
These Terms are governed by the laws of the State of Arizona, without
regard to conflict-of-laws principles. Any dispute will be resolved
exclusively in the state or federal courts located in Coconino County,
Arizona, except that either party may seek injunctive relief in any
court of competent jurisdiction.
*Note for counsel: confirm whether to add a binding-arbitration clause
and class-action waiver. California users may require AAA Consumer
Arbitration Rules; many AGs scrutinize these clauses heavily.*
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be
posted with a new effective date and surfaced in-app for re-acceptance.
Continued use of the Service after the effective date constitutes
acceptance.
